The Malawi Electoral Commission (MEC) has appealed to the Malawi Supreme Court of Appeal the Constitutional Court’s ruling which nullified the May 21 presidential elections.
MEC’s Lawyer Tamando Chokhotho confirmed on Friday few hours after President Peter Mutharika who was the first responded in the case instructed his lawyers to appeal the ruling to the Supreme Court.
Meanwhile, the Commission is applying for a stay order to set aside the ruling of the Constitutional Court pending an appeal.
On Monday, a panel of five High Court judges, headed by Justice Healey Potani nullified the 21 May 2019 presidential elections and ordered fresh polls within 150 days from the date of judgment.
In the case, UTM and Malawi Congress Party (MCP) petitioned the court seeking nullification of May Presidential polls citing the elections were marred with irregularities.
