…Contract and payment terms were already under negotiation with AG office
The Anti-Corruption Bureau (ACB) and Fiscal Police have cleared African Commercial Agency and Reliance Trading Company owned by Abdul Karim Batawarara of any wrong doing in the multi-billion kwacha Immigration Department Uniforms Supply Contract.
The two firms dragged the Department of Immigration to court for failing to pay them over MK 53 Billion as payment for supplying items such as Uniforms for immigration officers as per agreement.
Recently, Malawi government through the office of the Anthony General instructed ACB and Fiscal police probe Karim and Immigration department deal- which the office described as dubious.
However, a court document in our custody indicates that ACB and Fiscal Police had cleared the African Commercial Agency and Reliance Trading Company of any fraud and wrong-doing saying the two films followed all process before being awarded the contract.
According to the court document, on 8th March 2009 the Chief Immigration officer Elvis Thodi wrote to Africa Commercial Agency to advise them that they have been nominated to participate in the bidding process for the supply and delivery of uniforms and other items for the period of 2009, 2010 and 2012.
It further said on 20th March, 2009 Africa Commercial Agency sent it’s quotation to the Department of Immigration and Citizenship Services Internal Procurement Committee which evaluated their offer and was established as the lowest bidder with enough capacity.
Subsequently on 24th April, 2009 they were awarded the contract.
” The department followed due process and diligence. The Public Procurement Disposal and Assets Authority (PPDA) carried out due diligence and ‘No objection’ was granted.”
The company delivered the required goods, and the department of Immigration acknowledged receipt and part payment was issued per the terms and conditions of the contract.
