Of Elections, Contract and Fraud

Youth Promised 1 Million ‘Jobs’ during campaign

In that particular order, these words are real and are bothering me each day I wake up in the morning.

Election is a poll -an inquiry into public opinion conducted on a random sample of people.

In this case, the word ‘elections’ should particularly be defined as a vote to select the winner of a political office.

Before an election, a politician approaches people and tries to convince them with his or her manifesto – intentions of what to do when voted into power.

He or she pledges before them that should they vote him or her into power, he will, for instance:
Create 1 million jobs for the youths. They even do segment the market. They might have at some time studied marketing or a related course because it’s where market segmentation is found.

End corruption…and make available affordable agricultural inputs to all.

Prosper together with the voters, that is, if the voted will get rich, the voters will also prosper. Voters should be very lucky if they are also promised a rule of law.

When the voters vote for the person behind such pledges, they automatically assume a contract that s/he will only do what he promised to, or something closely related to that.

The decision by the voters becomes binding and the voted person starts implementing his intentions.

The word ‘contract‘ is a binding agreement between two or more persons that is enforceable by law.

The agreement is enforceable by law such that when the voted person starts doing things contrary to what s/he promised, the voters start viewing him or her a fraudster.  They can even oust him or her, physically or by vote again.

Fraud is a word that many people get arrested for and get sentenced for committing it. It is generally defined as an act of swindling by racket, or just swindling.

Fraud is in categories:

There is Fraud in Fact. This one is the actual deceit – concealing something or making a false representation with an evil intent to cause injury to another. It is alternatively called positive fraud.

Fraud in Law is another category. It is a fraud that presumed from the circumstances although the one who commits it need not have had any evil intent.

Fraud in the Factum category arises from a disparity between the instrument intended to be executed and the instrument actually executed. For instance, leading someone to sign a wrong contact.

The last category is Fraud in the Inducement. This is the fraud which intentionally causes a person to execute an instrument or make an agreement or render a judgement. For instance, misleading someone about the true facts.

My questions are: Did you really vote? Did you really vote for what is currently happening?
